Terms of Service

These Terms of Service ("Terms") govern your use of Misbah, including the Misbah mobile application, website, and related services (together, the "Service").

By accessing or using Misbah, you agree to these Terms. If you do not agree to them, please do not use the Service.

About Misbah

Misbah is a Qur'an reflection and learning service operated by Taseen Rahman, trading as Misbah. It is designed to help users spend more meaningful time with the Qur'an through guided journeys, reflections, activities, learning content, and related features.

Who may use Misbah

You must be legally able to enter into these Terms in the place where you live. If you are under the age at which you can enter into a binding agreement on your own, you may use Misbah only with the involvement or permission of a parent or legal guardian where required by law.

You must provide accurate information when creating or maintaining an account and must not impersonate another person or create an account for fraudulent or abusive purposes.

Your account

Some Misbah features require an account. You are responsible for keeping access to your account secure and for activity that takes place through your account, except where that activity results from something for which Misbah is legally responsible.

Please contact us promptly if you believe your account has been accessed without your permission.

You can request deletion of your account through the account controls available in Misbah. More information is available on our Delete Account page.

Using the Service

We give you a personal, limited, non-exclusive, non-transferable and revocable right to access and use Misbah for lawful, personal and non-commercial purposes, subject to these Terms and any applicable app-store rules.

You must not:

  • use Misbah in a way that breaks applicable law or infringes another person's rights;
  • attempt to gain unauthorised access to the Service, another user's account, or systems connected to Misbah;
  • interfere with, damage, overload, disrupt, or bypass the security of the Service;
  • use automated tools to scrape, harvest, copy, or extract substantial parts of the Service except where we have given permission;
  • reverse engineer, decompile, or attempt to derive source code except to the extent such a restriction is prohibited by law;
  • use Misbah to distribute malware, spam, fraud, harassment, or unlawful material; or
  • use the Service in a way that materially prevents others from using it normally.

Qur'an and educational content

Misbah provides Qur'anic, reflective, educational, and spiritual content intended to support learning and personal reflection. We work to present this material carefully, but the Service should not be treated as a substitute for qualified scholarly, legal, medical, mental-health, financial, or other professional advice.

Tafsir, translations, explanations, reflections, activities, or other educational material may draw on third-party sources, contributors, scholars, or content providers. Where appropriate, those materials remain subject to their respective rights and attribution requirements.

Your reflections and other content

You retain ownership of original content that you create in Misbah, including your personal reflections, answers, comments, or posts, subject to any rights that may exist in material belonging to others.

For content that you save privately, you give Misbah permission to host, process, store and display that content back to you only as reasonably necessary to provide, maintain, secure and improve the features you choose to use.

If you deliberately publish content in a community or other shared area, you give Misbah a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display that content for the purpose of operating and providing that shared feature. This licence lasts only for as long as reasonably necessary to provide the Service, subject to legal, security, backup, and dispute-resolution requirements.

You are responsible for ensuring that content you submit does not violate the law, another person's rights, or these Terms.

Community features

If Misbah provides community, commenting, posting, or other user-to-user features, you must use them respectfully. You must not post or share content that is unlawful, threatening, harassing, hateful, sexually exploitative, fraudulent, deliberately deceptive, invasive of another person's privacy, or that infringes intellectual-property rights.

We may remove or restrict access to content, limit features, or take action against accounts where we reasonably believe this is necessary to enforce these Terms, protect users, comply with law, respond to reports, or protect the integrity of the Service.

We are not required to pre-screen every piece of user-generated content and cannot guarantee that all community content will always be accurate, appropriate, or available.

Misbah's intellectual property

Except for content belonging to users or third parties, Misbah and its licensors retain all rights in the Service, including its software, product design, branding, original text, graphics, visual presentation, databases, and other materials.

These Terms do not transfer ownership of any Misbah intellectual property to you. You may not copy, reproduce, distribute, sell, commercially exploit, or create derivative products from protected Misbah material except where we have given permission or applicable law allows it.

Third-party services and content

Misbah may rely on or connect with third-party services, including authentication, hosting, Qur'an-content, analytics, diagnostics, notifications, app-distribution, or other infrastructure providers.

Those third parties may have their own terms and privacy policies. We are not responsible for third-party services that are outside our control, although we remain responsible for our own obligations when we choose providers to process personal information on our behalf.

App stores

If you download Misbah through an app store, your use of the application may also be subject to that app store's terms. For applications distributed through Apple's App Store, Apple's applicable standard end-user licence agreement may also apply unless Misbah provides a separate custom licence agreement through the App Store.

Changes to Misbah

We expect Misbah to continue developing. We may add, modify, replace, suspend, or discontinue features where reasonably necessary, including for product, security, legal, operational, or technical reasons.

We will try to avoid materially reducing important functionality without good reason and, where appropriate, provide notice of significant changes.

Availability

We aim to keep Misbah available and reliable, but we cannot promise that the Service will always be uninterrupted, error-free, secure, or available on every device or in every location.

The Service may occasionally be unavailable because of maintenance, updates, internet or hosting failures, third-party services, security incidents, or circumstances outside our reasonable control.

Suspension and termination

You may stop using Misbah at any time and may delete your account using the available account-deletion process.

We may suspend or terminate access where we reasonably believe a user has materially or repeatedly breached these Terms, created a security or legal risk, harmed other users, abused the Service, or where we are required to do so by law.

Where appropriate and lawful, we will try to give reasonable notice or an opportunity to address the issue before taking permanent action.

Disclaimers

Nothing in these Terms excludes or limits any guarantee, warranty, right, or remedy that cannot legally be excluded or limited.

Subject to those rights, Misbah is provided on an "as available" basis. We do not guarantee that every item of educational, community, or third-party content will be complete, current, error-free, or suitable for a particular personal decision.

Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or other liability that cannot legally be excluded.

To the extent permitted by law, Misbah is not responsible for losses that were not reasonably foreseeable when you agreed to these Terms, losses caused by events outside our reasonable control, or business losses arising from personal use of the Service.

These Terms do not affect any statutory rights you may have as a consumer.

Changes to these Terms

We may update these Terms as Misbah changes or where needed for legal, regulatory, security, or operational reasons.

If we make a material change, we will take reasonable steps to bring it to your attention. The "Last updated" date at the top of this page shows when these Terms were most recently revised.

If a change requires your consent under applicable law, we will ask for it before the change takes effect for you.

Governing law and disputes

These Terms are governed by the laws of England and Wales, except that if you live somewhere whose mandatory consumer laws give you additional protections, those protections continue to apply.

Nothing in these Terms prevents you from bringing a claim in a court that you are entitled to use under applicable consumer law.
